Terms of Service

1. Acceptance of Terms

By accessing or using Eventtree ("the Platform"), operated by Eventtree, Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform. We may update these terms from time to time, and continued use of the Platform constitutes acceptance of any changes.

2. Description of Service

Eventtree is an online event ticketing and management platform that enables event organizers ("Hosts") to create, promote, and sell tickets to events, and enables attendees ("Buyers") to discover and purchase tickets. We act as an intermediary and are not the organizer of any event listed on the Platform.

3. Account Registration

To use certain features, you must create an account. You agree to provide accurate, current, and complete information and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must be at least 18 years old to create an account and use our services.

4. Ticket Purchases

When you purchase a ticket through the Platform, you are entering into a transaction with the event Host. Eventtree facilitates the transaction but is not a party to the agreement between you and the Host. All ticket sales are subject to the Host's refund policy as displayed on the event page. Ticket prices are set by the Host and may be subject to service fees and payment processing fees as disclosed at checkout.

5. Service Fees

Eventtree charges a service fee of 5% plus $0.50 per paid ticket. This fee may be passed to the Buyer or absorbed by the Host, as determined by the Host. Additional payment processing fees (Stripe: 2.9% + $0.30) apply to all transactions. Free events incur no fees. All fees are non-refundable unless otherwise stated.

6. Refund Policy

Refund eligibility is determined by the Host's selected refund policy for each event:

  • Flexible: Full refund available up to 24 hours before the event start time.
  • Moderate: 50% refund available up to 48 hours before the event start time.
  • Strict: No refunds available after purchase.

If an event is cancelled by the Host, Buyers are entitled to a full refund. Refunds are processed through the original payment method and may take 5-10 business days to appear.

7. Host Responsibilities

As a Host, you are solely responsible for the accuracy of your event information, compliance with all applicable laws and regulations, obtaining necessary permits and licenses, the safety and experience of your attendees, and fulfilling all obligations to ticket holders. You agree not to list fraudulent, illegal, or misleading events. Eventtree reserves the right to remove any event or suspend any Host account that violates these terms.

8. Host Payouts

Hosts receive payouts for ticket sales after the event has concluded. Eventtree handles all payment processing and deducts applicable platform fees before issuing payouts. Payout timing is typically 2-7 business days after the event ends.

9. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable laws
  • Create fraudulent events or listings
  • Resell tickets purchased through the Platform at inflated prices (scalping)
  • Attempt to circumvent or manipulate our fee structure
  • Use automated systems to access the Platform without our permission
  • Impersonate any person or entity, or falsely represent your affiliation
  • Interfere with or disrupt the Platform or its infrastructure
  • Collect personal information of other users without their consent

10. User-Generated Content & Moderation

Eventtree allows users to create event listings, send messages, and post other content ("User-Generated Content" or "UGC"). You are solely responsible for all content you create, upload, or share on the Platform.

We have a zero-tolerance policy for objectionable content, including but not limited to:

  • Abusive, threatening, or harassing content
  • Hate speech, discrimination, or content promoting violence
  • Spam, scams, or fraudulent activity
  • Sexually explicit or inappropriate material
  • Impersonation of other individuals or organizations
  • Sharing private or personal information without consent

Users can report objectionable content or abusive users directly through the app using the Report feature. All reports are reviewed by our moderation team, and we are committed to responding to reports within 24 hours. Objectionable content will be removed promptly upon review. Users who violate these guidelines may have their accounts suspended or permanently banned. By using the Platform, you agree to abide by our Community Guidelines.

11. Intellectual Property

The Platform and its original content, features, and functionality are owned by Eventtree, Inc. and are protected by copyright, trademark, and other intellectual property laws. Content uploaded by Hosts (event descriptions, images, etc.) remains the property of the Host, but by uploading it, the Host grants Eventtree a non-exclusive, worldwide license to use, display, and distribute such content in connection with the Platform.

12. Limitation of Liability

Eventtree is not liable for the actions, content, or conduct of any Host, Buyer, or third party. We do not guarantee the quality, safety, or legality of events listed on the Platform. To the maximum extent permitted by law, Eventtree shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue. Our total liability for any claim arising from or related to the Platform shall not exceed the total fees paid by you to Eventtree in the twelve months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Eventtree, Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform, your violation of these terms, or your violation of any rights of a third party.

14. Termination

We may terminate or suspend your account and access to the Platform at our sole discretion, without notice, for conduct that we determine violates these terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Platform ceases immediately. Any pending payouts for completed events will still be processed.

15. Dispute Resolution

Any disputes arising from or relating to these terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in a class action. This arbitration agreement does not prevent you from bringing issues to the attention of governmental agencies.

16. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
